In connection with the entry into force of Regulation (EU) 2016/679 of the European Parliament and of the Council of On April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (“GDPR”), we would like to inform you that the „Warsaw Legal” Law Firm & Business Consultation processes, among others, data personal:

  1. natural persons,
  2. in the case of clients who are legal persons or organizational units without legal personality – personal data of persons authorized to represent such entities, employees and associates of such clients,
  3. service providers who are natural persons, as well as employees and associates of service providers;
  4. persons reporting to the Law Firm for help in the area of legal and business consulting provided by the law firm, as well as persons whose data was obtained while providing such services to the clients of the Law Firm;
  5. persons cooperating with the Law Firm permanently or sporadically in rendering services by the Law Firm;

In connection with the above, we provide you with relevant information related to the processing of personal data.

PURPOSES OF DATA PROCESSING, LEGAL BASIS AND LEGAL JUSTIFIED INTERESTS

Please be advised that your personal data will be processed when it is necessary for:

  1. conclusion and performance of the contract, i.e. pursuant to art. 6 clause 1 lit. b GDPR, including in particular legal services contracts or contracts for the provision of services to the Law Firm by providers of such services;

2.compliance with legal obligations of the personal data administrator pursuant to art. 6 clause 1 lit. c GDPR, arising from Union law or Polish law;

3.for purposes resulting from legitimate interests pursued by the administrator or a third party pursuant to art. 6 clause 1 lit. f GDPR, for which the administrator considers in particular: investigation, determination and defense against claims, prevention of fraud, ensuring the security of the ICT environment, the use of internal control systems, monitoring of the Office and registration of entries and exits from the Office, determination of conflicts of interest and ethical violations to the extent necessary to prevent abuse, for archival and statistical purposes, as well as the provision of services to the client in situations where the client’s interest prevails over the interests, rights and freedoms of the data subject.

CATEGORIES OF PERSONAL DATA PROCESSED

The Law Firm processes the following categories of personal data:

* identity details, such as name and surname, PESEL number, ID card number, date of birth;

* contact details, such as: phone number, email address, home address;

* tax identification data;

* the education and professional experience – if necessary from the point of view of services rendered;

* the property and financial situation – if necessary from the point of view of services rendered;

* professional and business activities;

* the marital status – if necessary from the point of view of services rendered;

* photo – to the extent necessary from the point of view of services rendered;

In addition, the Law Firm may process other categories of personal data, provided that it cannot be classified to any of the indicated groups, and the processing is carried out for the purposes specified in this information;

DATA RECIPIENTS CATEGORIES

The recipients of the data can be entities from the following categories:

* advocates, legal advisers, notaries and other entities providing legal services and independently deciding on the purposes and methods of data processing cooperating with the Law Firm;

* entities authorized under applicable law (in particular courts and state authorities);

* entities providing services:

– accounting and financial;

– IT and new technologies;

– payment;

– auditing and control;

– debt collection;

– printing;

– destruction of documents;

– postal and courier services

* buyers of the law office’s receivables;

* business information bureau;

TRANSMISSION OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA

The Law Firm generally does not transfer personal data outside the European Economic Area. The Law Firm may, however, outsource specific services or IT tasks to service providers established

In this case, the data is transferred to a third country for which an adequate level of data protection has been established on the basis of a decision by the European Commission. DATA STORAGE PERIOD

  1. a) in order to perform the contract (s) – until they are terminated or expire;
  2. b) determination, investigation or defense against claims – until the claims are time-barred or an objection is lodged;
  3. c) to fulfill legal obligations incumbent on the Office – until the obligations arising from legal provisions expire.

RIGHTS

* the right to access your personal data, rectify and supplement it, limit its processing and deletion;

* the right to transfer personal data that you have provided to the Law Firm, i.e. the right to receive it in a structured common format and send it to another administrator. This right can be exercised only in cases where the processing is carried out on the basis of consent or contract and if it is fully automated.

The right to lodge a complaint to the supervisory body dealing with the protection of personal data if it is considered that the processing of personal data violates the GDPR

OPPOSITION LAW

You have the opportunity to object to the processing of personal data, provided that the processing is carried out for purposes arising from legitimate interests pursued by the administrator or a third party, i.e. pursuant to art. 6 clause 1 lit.f GDPR.

The reason for this objection must be your particular situation. After receiving the objection, we will stop processing your data for the above purposes for which you objected, unless we prove the existence of valid legitimate grounds for processing, overriding your interests, rights and freedoms or grounds for establishing, investigating or defense against claims.

RIGHT TO WITHDRAW CONSENT

Insofar as the processing of data takes place on the basis of the consent of the data subject, the data subject may withdraw his consent at any time, whereas the withdrawal of consent does not affect the lawfulness of data processing carried out on the basis of this consent before its withdrawal.

INFORMATION ABOUT THE REQUIREMENT OR VOLUNTARY DATA, AND THE CONSEQUENCES AND NON-SUBMISSION

In the scope of processing personal data for the purpose referred to in point 2 above, the obligation to provide data is a statutory requirement; in turn, in the case of data processing for the purposes referred to in points 1 and 3, the obligation to provide data is a contractual requirement – providing personal data for all purposes referred to above is voluntary, but it is necessary to conclude and perform a contract with the office.
